The best providers for these services are located in the countries where the languages are spoken. Full immersion allows them to stay current with evolving language usage and maintain fluency. Additionally, these countries are more likely to have available linguists for the respective languages compared to others.
Note that not all these countries are within the EU or on the European Commission’s list of approved countries. For instance, China, India, Japan, and the UAE are not included.
Under Article 49 of the GDPR, data transfer outside of the EU is permitted under specific circumstances. As a language services provider dealing with documents containing personal data, we rely on one or more of the following clauses from Article 49:
- the transfer is necessary for the performance of a contract between the data subject and the controller, or the implementation of pre-contractual measures taken at the data subject’s request;
- the transfer is necessary for the establishment, exercise or defence of legal claims;
- the transfer is necessary in order to protect the vital interests of the data subject or of other persons, where the data subject is physically or legally incapable of giving consent;
Before transferring any documents containing personal data to linguists outside the EU, we will inform you in accordance with clause (a) that this is what we will be doing:
- the data subject has explicitly consented to the proposed transfer, after having been informed of the possible risks of such transfers for the data subject due to the absence of an adequacy decision and appropriate safeguards;
If the files contain personal data, we will inform the data subject about the possibility of transferring their data outside the EU and adequate countries to fulfil the contract and seek their consent.
Rest assured that all our linguists, regardless of their location, strictly adhere to data privacy and security rules. We implement protection measures for all data transfers (refer to our Information Security Policy for more details).
If, for any reason, the data subject does not provide consent for data transfer to linguists in third countries, we will explore alternative suppliers within the EU or adequate countries. However, this may impact the turnaround timeframes for the project.
